Money given during jun 2009

Hi All,

 

I have given Rs: 25000 to relative (online transfer) as my wife asked for help.

I have never received money back, what action I can take against relative? I need money for my other urgent needs.

If statutory limitation is over? or can I still file 420 etc... cases?

If yes then what are the sections cases I can file now.

file recovery suit for Rs.25000/- under civil law

second option if you have proof of repayment promise or return money in a specified time then you file complaint against your relative U/S 406 AND 420 in police station or Court.

You cannot file any criminal case against him, bsince it is purely of civil nature.  Even your civil case is very weak and winning chances are very few.  By hiring an experienced lawyer you can contest the case to some extent.  Because you have no proof of giving loan except online transfer.  

 

On the contrary the party to whom you have given money can say that He had given a hand loan and in return of it you have repaid the amount by way of online transfer.

Agreed with the views of Sh. Ravinder P., Less chance of recovery by legal ways, try moral pressure.
