The ‘Law of Limitation’ prescribes the time-limit for different suits within, which an aggrieved person can approach the court for redress or justice.

If one does not go to court within that time, the courts will not be of help to recover your money. This is called the limitation period, one may not enforce any rights in a court after the expiry of such period.

However, Article 61 provides three years' limitation from the date when the money is paid, for a suit to recover money payable to the plaintiff's for money paid for the defendant.

Suit for recovery can be filed within three years from date of payment of money.

The most important thing is from which day the limitation period starts. The date starts from the last credit with signatures or from the date of acknowledgment of debt obtained within 3 years from the date of such debt acknowledgment. Contact a local advocate and show him all the documents available to you. He may explore using the documents in your custody for bringing the suit within limitation period.
