Monthly Maintenance charges

Hi,

We are a new RWA and I am member of it, we are trying to finalise model of Monthly maintenance charges in our society of different size flats.

Some position holders in RWA are trying to push for equal MMC fo every flat irrespective of the size of the flat while most of other members are in favor of per sq foot rates( which is a common thing across societies).

How can we stop them pushing their agenda since they are doing it for their own benefit because they are owners of bigger flats.

Can we oppose it in RWA meeting through voting or can oppose it in General Body meeting when the resolution is put on floor.

This has not been added in by laws of our society yet and will be added if passed either way.

Second, can we pass in confidence movement against one position holder against some one if more than 50 % RWA members are willing to do so.

Please advise.

The common practice is to charge based on the square feet. However, the model bye-laws reflect different position and bit vague. If the society has adopted the model bye laws without suitable modifications on the maintance charges, it would be difficult to oppose the move for uniform charges. The MC should be able to unanimously OR at least by majority decide on proportionate charges based on square feet and then pass a resolution to modify the bye-law suitably to provide for proportionate maintenance charges. Try to bring a harmony rather than differences and disputes. An analysis on the mode of maintenance charges by various societies can be charted and presented in the meeting to bring consensus.
