A person X has died in a road accident in 2010. His widowed wife and their sons have filed a compensation claim and have won the orders for compensation in 2015. This happened in the Motor Vehicles Tribunal Court. But in the compensation claim, they did not include the daughters of the deceased persons (neither as Petitioners nor as Respondents).The petitioners also did not mention anything about the existence of the married daughters, who are also legal heirs of the deceased persons. This is a required step as per the MV act. All the legal heirs should be made as ' party' in the suit by the Petitioners. There was a wilfull suppression of this fact. Whether such hiding of the legal heirs, amounts to 'suppression of material facts' ?
