motor vehicle claims

sirs,

the petitioner filed petition under section 166 of M.V. Act, seeking compensation for the injuries sustained by him in morot vehicle accident. he was treated as out patient in a hospital. medical bills are filed on record. in the meanwhile when during the pendency of the petition he died and his legal heirs are brought on record. as he died after 6 months of the accident the post mortem was not conducted and it is to be noted that even FIR was not lodged.

now my question is whether the registration of FIR and post mortem report are mandatory to claim compensation under M.V.Act?

how to go about all this?

pls furnish case laws if any.

pls do guide.

pl note that LR's are stepped in to the shoes of deceased now so registering FIR does not arise. The case will be treated as injury case only. for case laws pl refer Accidents claims journal (ACJ)or Accident claims cases (ACC)
