Mou first or mcd petition

Dear Ld. Experts,

please could you advise if I there is any merit in executing an MOU before filing MCD petition. In many threads in this forum, I have read that there sould an MOU before petition, however my lawyer suggest that MOU conditions can directly be incorported in petition itself. Please could you advise any implication that may arise.

Its not necessary to go for MOU before filing MCD.  If it is consent petition, prepare a comrpomise petition in that petition you can write down the conditions and agreements.

I always suggest a MOU followed by a MCD to my clients. Keeps things really simple. MOU is also very useful if there is a FIR registered in the case.

Yes your lawyer is right in mcd you can directly write down your consent points in your mcd petition .

Though there are mixed response,  there seems to be no harm in executing an MOU before MCD.

what you want to insert in the MCD petition can be made a MOU which will safegaurd both parties priorities when any confilict arised but this MOU will not have any legal binding and only on petition you have legal right to question through legal only
