Munsiff Court Order

Hello, I have a question on an Order Passed by the Hon Munsiff. A CBSE school in our region is imposing huge hike in school fees for last 2 years without consulting with the PTA. Last year (2008-2009) the PTA made a petition at the Munsif court and an order was passed Order in IA 1196/08  . The school appealed at the CMA court which was rejected. Later they went at the High Court (  Hon’ble High Court on 17/03/2009 on W.P.(C).No.8536 of 2009 ). The school accepted the orders and made refund to all the parents.

Again this year (2009-2010) the school raised the fees above the fees they tried in 2008-09. Thogh the PTA made several attempts to discuss the matter and settle, the school management were not willing. The PTA had no chance other that approching the Court again. O.S 891/09 is filed and as per the order in IA 2112/09 the school are directed to maintain statusquo with regard to the fees. The said order is clarified by the court on 23/12/09 to the effect that students need not pay the new fees until further orders. Thereafter on 19/02/2010 Hon’ble Munsiff court again passed an order against the school in IA 295/10 directing them to allow the students of class X to XII of S.N Vidya Bhavan in writing the examination to be held in the month of March 2010. Though the orders were passed against the school and asked to maintain statusquo, the school authorities refuse to accept the old fees. They insist on parents to remit the hiked fees with thretening notices. When the statusquo order was issued the school authorities accepted OLD fees from 2 persons who were the petitioners. 

Now the management has sent a new notice to the parents to remit the refunded fees of 2008-2009 within 10 days which the parents got thru the order Order in IA 1196/08 . 

The school, though CBSE byelaw states is collecting capitation from 10K - 25K. As per the audited trail blances of the school, they make a profit of 65 - 70 Lakhs a year (School runs under a charitable trust). Thogh they make such huge money, no improvements are done at the school. For the year 2009-2010, school said they are revising the fees for digitailisation but until now (towards the end of academic year) no measures have been taken for digitailisation. 

There are so many other issues like lack of toilet facilities, asbestos sheets used for school, no principal for 3 years etc etc. (Some details can be seen at www.ptasnvb.com ) All the orders and details are also on the same website

Please advice what measure we should take from the parents side.

All the parents to come together on a common platform and complain to:

1. Education Department

2. Charity Commissioner

3. CBSE

4. File a contempt petition

5. To save child's future, send the fees by cheque by regd A.D. with a covering letter.
