Mutation of society plot

My father had purchased a property in 1992. As per the registry the property was under a society. Is mutation required for such a property? If yes then what is the procedure to do so as the property was bought way back and the seller's whereabouts are unknown now.

The fact is that mere mutation can neither get nor oust ownership rights acquired through legally valid registered title deeds.    When once such a legally valid title deed is in your possession, with actual possession, the seller's presence may not be essential and even if such rule exists, it may be a mere formality that can be managed..  You can file RTI Application to the Registrar of societies and can get a certified copy of laid down norms.  Search their website for the format of RTI Application with prescribed fee of Rs.10/- and you can seek information as follows:

 

Facts relevant to information sought: Property No...................of .......................society (Regd No................)  purchased on..................by.................................  Laid down norms on mutation.

Information solicited:  Please provide the certified copy of laid down norms that state that

a)Mutation is mandated for such purchase.

b)Procedure for mutation as per laid down norms.
