Mutual consent divorce

Hi,

I have filed a divorce case in December 2014 and it is still running.  Recently we both opted out to go for mutual consent and we are filing mutual consent divorce on January 9th, 2017.  Can you please tell me in how many days the divorce order will be issued.

You both can file an affidavit in court to convert the divorce petition to Mutual divorce petition.

Else,

 

You can withdraw the present petition, then file  a fresh petition of mutual divorce

In case of MCD court will grant you six month cooling off period after that divorce will be granted

From the date of filing application for mcd you both need to appear before the court after six months during first motion and thereafter another six months for second motion and you will be granted divorce

Get your divorce case converted to MCD, no need to file seperate MCD application. You will be granted MCD within shortest possible time.

Existing contest Divorce Petition pending for more than 6 months can be converted to MCD to get the waive off of 6 months statutory period.
