Mutual divorce - shortening the time etc

Dear LCI members

myself and my wife are living separately for more than 4 years and we are intending to file for mutual divorce.

pls help me on the following doubts

1.  can the period of 6 months be shortenend ?

2. we both live in the same house but myself in ground floor and she in the first floor. will this be considered as living separately?

3. should the witnesses has to appear in the court while filing the petition? if not when they should appear

4. when should i settle her as per MOU? is it safe to settle within the six months time?

Mr.Govind You can't shortened the 6 months period, it's mandatory.  recently the period of 6 months changed to 1 years.

Since you both are living in the same house it doesnt a problem for getting divorce, since you have applied 13-B Mutual Divorce

Witnesses presence is not required in court for any of proceedings

You can settle both of your terms and conditions on the day of judgement, prior to that - it's let to you
