Is there a jugment where the maximum medical expenses which are given under s163a-sch2 have been enhanced (from max. Rs.15,000/) due to rise in costs?
My client's medical expenses have crossed Rs.40,000/- and i don't want to file under sec.140/166.
Smt. Rukmani Devi vs The New India Assurance Co. Ltd- 19 May, 2008- says that 40k annual salary can be dispensed with. How can this Delhi HC judge go against Deepal Girisgbhai soni's case (SC)-does this not go against judicial discipline?
