My tenant is not leaving after giving me surrender letter

I am from Kolkata . I let out my ground floor to my tenant for three years. At the end of the agreement the tenant gave me a surrender letter (in typing duly signed by the tenant and also witnessed by 2 person from my side) that he is vacating the property . But after due date he has not vacated my property and he is still occupying my property for over 9 months and now trying to deposit rent in Rent Control. I have also returned all security deposits and advance given by him before the end of the agreemnent and it was also signed by him. How can I vacate my property ?

Treat this as house was vacated on the date you received surrender letter from him  and now make a police complaint that he made aduplicate keys and forcefully occupied the house.
