Name transfer of house after fathers death

Sir,

my father died last year intestate. he has a house in his village in his name with two unmarried sisters of my father residing there.

i made an application to transfer the name to my brother . but gram panchayat replied me back that i should say make a statement in front of them. without which they cannot take any further action.

now aunts are not willing to visit the panchayat office. 

can i file a case against gram panchayat .

please advice

Panchayat suggestion is correct. You cannot file a suit against panchayat in this regard.

Mr.Yogesh,

There is no illegality prevailed in the saying of grampanchayat, as they are rightly submitted that you need to present before them to transfer of ownership to your brother.

As there is rules governing with respect to work of panchayat prevails which states that, whosoever wants to remove/release his name from the ownership of the property situated in a village, they need to make statement on the affidavit thereof and present and submit the said affidavit with the grampanchayat office and thereby verfiy and confirm the same.

I do not understand the stand taken by your aunts. There is no requirements of any NOC or confirmation from your aunts for transfer of such ownership to your brother's name.
