Hi there ! I need a judgement wherein the top courts had directed the Insurance company to pay the claim amout in the case of "no written intimation to the Insurance company about the receiving of an legal summon at first stage also the the insured had failed to implead the insurer in the initial stage of case" The case here is related to a doctor who had purchased a indemnity policy which covers the legal liability of the consumer, unfortunately the case of medical negligence was lost by the doctor and the court had directed to pay the claim amount to the patient, as the doctor was insured, the was supposed to be paid by the Insurer, that due to the failure in intimation to the Insurance company the co. had repudiated the claim, now we have filed a consumer case against the Insurance company. Therefore need few supporting judgements.
