Need advice

Experts,

If my friend buys a second property solely in his name while his divorce proceeding is in progress and pays for it on his own. Can his wife have a claim on this property? Both are living separately and the case is going on since more than 4+ years.

No she cannot.

Wife has no right in the property of the husband during his lifetime, her right to inherit the share in her husband's property arise only after his death if the marriage was in existence and not dissolved before his death.

He can enjoy his property as he so desire without giving an inch of it to his disgruntled wife.

Sir,

If the divorce proceedings are not settled, and the decree of divorce is not absolute, the legally wedded wife can very well demand inclusion of the newly purchased property, while considering the capital/wealth of the husband, at the time of property settlement.

Good Luck,

Kishor Mehta
