Need your help on maharashtra shops act ,1948

Dear Forum Members With due respect to you and to your Chair. On 20th July 2016, Two Shops Inspector along with Senior Shops Inspector visited our Establishment NO irregularity found except not maintaining prescribed Inspection Visit Book. Duly Intimated to them within 7 days about compliance toward Visit Book. Our Establishment has two Registration Certificate due for renewal for the year 2017, inadvertently Changes occurred in July 2016 due to 2 partner leaving the establishment and in their place 2 new appointed has not been intimated within 30 days to the Shops Authority in Form E. In the last week of November 2016 we made application for renewal as well as intimating changes in Constitution. Same 2 inspector & Senior Inspector again visited the establishment on 6th Dec. 2016 passed the visit remark on Visit Slip purposely not calling for Inspection Visit Book and passed the remark for not intimating the change in the constitution with in 30 days since July 2016. Before 15 December 2016 all the fees pertaining to change in number of employee as well as Change in the name of partner are complied. After lapse of 11 months, On 24 November 2017 we receive Summon from Metropolitan Magistrate Court to be present on 1st Dec 2017 @ 11.00 am, intimating breach of Sec 8 read with rule 8 and Rule 20(13) (a) (b) detected on 6th Dec 2016. Before Metropolitan Court Can we invoke Sec 61 of the Act. - Limitation of Prosecution? As a preliminary issue? We presume that we have not meet nefarious demands of Inspectors they might have filed back dated compliant before Metropolitan Magistrate Court. Secondly if Inspector has filed compliant before the Court in time. Does Magistrate Court takes it own sweet time to issue Summons to Accused Persons. A line in reply is Appreciated. Regards, Azim
