Neighbour is encroaching

Dear Sir,

My neighbour has constructed a three storeyed building using the entire 9'' wide common wall, without seeking my permission. He has covered the area of common wall which comes  under my possession. Even afer constructing a huge wall on entire common wall, now he is forcing to put plaster on my side of wall which comes under my posssession. How can i stop him doing so legallly? Please help me

If he has used your 9" wall and has not raised any wall on his sides then ideally he should pay you for the 4'' wall @ cost at the time you constructed your wall.

You should have objected and stopped his construction by involving the authority e.g. state urban development agency, or Nagar Nigam, councilor etc.

You may involve the neighbourers, councilor, welfare society and concerned authority, and stop further construction till the issue is resolved. If he creates a scene you can lodge a complaint with police and issue a legal notice.

If the wall is already constructed then file a suit for mandtory injunction to remove the wall.
