No access road to a piece of our land

Hello Lawyers,

We have a piece of land which is surrounded by agricultural land owned by others with no access to it. This land in question is our ancestors land. The main road is about 200 meters and one of our relative own it. He is not ready to provide access path to our land even we are ready to pay or five some portion of our land to him. Currently its a bare land with no cultivation in it. Is there any way to get access to it ?

If it was ancestral land, how you are un possession? If a partition was carried out, was no access provided? So also, how was the land cultivated and produce removed without any  access?

It is not believable that the ancestral land was not provided road access or not provided with pathway for ingress and egress.

However you have to get your partition deed scrutinized by an experienced civil law practicing lawyer and find out the terms of the pathway mentioned in the registered deed.

If there's no pathway provided in the deed then you can file a suit for easement rights necessity through the local lawyer.
