no objection certificate of society

if a society has completion certificate and a few flats are built afetrwords in the same society with municipal corporations permission but their is no completion certificate available for them. And if such flatholder wants to sell that flat and seeks NOC from the society.

in this case is it possible that society can refuse to give NOC for only reason that the flat dosent have CC for it, though the flat holder has paid all his monthly maintenance bills ect. in time. even the flat holder has all other documents from builder such as agreement, possession letter etc.

While purchasing the flat, you have committed the mistake for not getting or insisting the CC from the promotor/developer. It is not the fault of the Society. Society is no way responsible. Try to contact the Builder/promoter & contact the Municipal Office since construction was with the permission of Municipality. Or else you have to take recourse legal remedy.

My question is for this reason (of not having CC ) can society refuse to give no objection certificate when we will sell our flat to some other party?

Because we have paid all our monthly maintenance bills as well as other dues in time.
