No proper documents

 

 

 

Dear Sirs,

In our area there is a temple and locals say that the surrounding land belongs to temple. But some say that they have purchased the land and have proper documents (they are not sure about from whom they bought as there previous generation people bought the said land). 

We have a document which states that the trustee of the temple has given the land for lease to my grandfather and father in 1950's to expand the school which my grandfather started.  Also in 1972 it shows they extended the lease for another 5 years.

Since 1977 there was no extension of lease and we are in possession. We pay only electricty bill for that place, since goverment said no need to pay property tax for the goverment aided school. So we don't have any documents. Now we are planning to demolish and build new structure. The previous building structure has been approved by the corporation of Chennai.

Also many people live in that area for more than 50 years and they do not have any legal documents while some managed with some fake documents. Now they have started giving patta for this surrounding. 

My Questions :

1) How to check whether the land really belongs to temple ?

2) Can we register the land in my name without any documents?

3) If I apply for patta without any documents except the Electricity bill that shows we are in continous possession of this property. Will they give patta.

4) Do we have to check whether the land is registered in the name of the temple.

first your donot have any lease, so first the lease has to be extend in your nam, without documents no register office will register in your favor 

1. fist you apply for EC in register office so that the whether the said land belongs to temple or not

2. you have to fill a petition before the AP Endowments tribunal to declare that your not encrocher of the said land


3. Are you having any lease documents is the question so that we can see the provision under Act 30/87

Dear Sir,

First of all, I thank you for spending your time for my concern. Yesterday some people from Tashildar office came to our area and said they are giving patta to all in our area.  They gave us a recipt kind of thing in which they have marked our land area in name of my father.

 

We went yesterday with that slip to Tashildar office and they said that the said land is in the name of my father, so i produced my legal heir certificate and they said they will give patta in my name. Am not sure how long it will take. Also I have applied for EC which I will propably receive after Dec' 20th.

So what shall I do now?

Hi,

I'm also facing a similar situation with long term lease from temple(which has expired now) and owning only the superstructure. How did you approach the Tashildar's office about patta? Can I do the same?

Dear Thomas,

1. We never approched them, it seems they got some orders to give patta for our area. They are still collecting documents from different area.

2. Which area do you belong also check whether your land is Grama Natham.

3. Also how long are you in possession.

 

Coz some say Grama Natham means it belongs to goverment and only they have to decide. If so then it doesn't belong to temple I guess. So please check with someone who has better knowledge on this.

Dear Sir,

We are in the city center near Egmore. The property has been in our family for about 95+ years. I will check about the Grama Natham - any idea where I can get this information?

The temple claims the land belongs to them and they keep increasing rent. Now the arrears are substantial. Although we have been in possession for the past 95+ years(superstructure, water bill, electricity bill are all in my name), there is a possibility the temple might try to evict us.

Any help or advice would be highly appreciated.

If you have the Survey number, Please follow the instructions given by Sriram karthik Sir,.

Apply for EC in register office so that we can check whether the said land belongs to temple or not.
