Non payment of daily wagers

Dear Advocate

Please give your expert advice..

in the matter of daily wagers not paid fully by contractor( who is still working with us),, 

1. Can the expelled labor can file complaint against us.

2. Can they file in other state( own state)

3. We got the call from State Adminstrative officer to clear due directly.

4. we asked for 2 months time but he refused, and said they will proceed to file the case, and therafter we have to visit there state.

5. Please guide., is it a summon system, or any other. can we demand to transfer the case in state of emplyment.

6. what are the repercusions. we donot want dispute but only ttime.

7 can we ask for complaint copy and reply therafter.

A daily wagers not paid fully by contractor( who is still working ),

1. The expelled labor can file complaint , the workman is entitled for wages earned.

2.They cannot file in other state ,

3. State Adminstrative officer (Labour Officer) can direct to clear due .

I agree with Dr. Vashista's opinion.  The other state Labor officer cannot initiate any legal action against the other state person for the event that happened in other state that his own, labor laws and rules differs from one state to another.

Dear friend,

The daily wagers should be paid minimum wages as prescribed by the State Government. The payment of wages may be daily , weekly or as per mutual agreement with daily workers and their contractors monthly. But being a principal contractor , you are responsible for payment to the daily wagers. you have to see whether they are getting wages properly. 

In case of non payment of wages they can file complain against your company and the concerned authority will bound to take firm action against your firm or company. But they have to file their complaint in same state not in other.
