Nonfulfilment of terms of employment

I am a retired officer in a pvt company.

I was entitled to a commission on the Net profit of the company for the Financial year as per the terms of my appointment in writing

If the company does not pay or try to minimise the profit by terming some income as non business income although it is part of company,s profit is it right.

Is my contention that net profit of the company includes all profit as long as it is earned by company and shown in the Audited statements right.

Can i apprroach the labour commissioners office for redressal.

Does my designation of Officer come in way of seeking redressal from labour commissionres office.

What are the other alternatives ?

Are there any case laws relating to it?

If the amount due to me is Rs 3.50 lakhs what should be the fees payable if i have to file a writ or moove the court to claim my dues?

What is the best method. 

I seek suggestation and advise

You can claim your dues by filing a civil suit only and agitate your claim on facts in the court. You canot approach a LC . the  court fee differs from state to state. You can consider it on average at 6000/-
