Not allowing to occupy the flat

Hello Sir/Medam,

'I have purchased apartment flat in Mangalore(Karnataka) and registration also done some time back.But now builder is not allowing me to occupy the flat and saying he is not received money (but have bills on letterhead singed buy the marketing guy and same guy put singn for rest of the flat owners as well).

Actually i have paid amount as cheques, Bank loan and 8 lakhs as cash to his marketing executive.But now builder is saying he is not received 8 lakhs cash and rest have been received and suspecting that marketing guy had taken money and not paid to builder.So builder asking me to get the money from the marketing person.

Now i have given enough time to both builder and marketing guy but issue is not being resolved.so would like to take some action of these guys.

My questions is :

1.Who is the responsible for the issue and on whom we can take action(builder/marketing person or on both ) ?

2.Which case is suitable for this ? (Police case,Consumer court or Civil court)

3.If i file case on Consumer court, how much time it may take ?

Approach consumer court. The builder will not register agreement unless he gets black component.

The builder will be forced to deliver the flat to you.
