Not retuning to work after availing loan leave

Dear Sirs,

 

Kindly advice me that what proceedures we need to adopt for an employee who is not retuning back to work after 5 years of long leave,  there is a condition in the standing orders of the company that those who are not reporting to duty after 8 days of completion fo long leave will be terminated.

The employee is served the charge memo vide registered mail and it is returned and after local enquiry it is found that the delinquent employee is abroad. so what is the next step?

Get a notice of inquiry published in a local newspaper. Hold an inquiry ex-parte and then terminate. Automatic termination as per standing orders shall not help.

Mr.Haribhajan has given a very valuable suggestion. When the notice is returned then immediately get published in two ( one local language & other one in enlighs) highly circulated news papers regarding the absconding and as well as the enquiry place, time and date of enquiry, conduct enquiry and terminate.

If you are able to establish that the delinquent employee is abroad in the enqquiry proceedings then it is well and good.

dear sir

 

After completion of the enquiry, pls send  copy of findings to his registered address on record and his permanent address also, calling for his comments.  Then you can terminate him.
