The main orginal petition is ordered. There were 8 respondents in the main original petition. Only R6 and R8 filed vakalath and their counsel appeared. Others were absent throughout the case. The main original petition was contested and ordered.
Now we filed application for Return of documents. Counsel for R6 and R8 appeared in the application.
My question is whether notice is necessary for other respondents who were absent throughout the main original petition. Is there any case law relating to this issue.
Notice of application for return of documents to respondents who were absent in original suit/petition is not necessary as they did not file their reply/objections in main/original suut/petition.
