Notice period

Does a 3 month notice period for employment in school includes summer vacation of approximately 45 days? What is the start and end month of an Academic Year? Reason for this query is - Resignation letter was given on Feb 28, under the assumption that 3 months notice period will end on May 28th. The school refuses to pay salaries for the month of March,April and May. The institute had circulated a notice 3 months notice period is required but has not mentioned that vacation period will not be considered as working days for resigning employees. Working days of the academic year closes on April 11th and will re-open next academic year any day between June 1st to June 6th. The employee opines that even if not paid for vacation days, full Salary should be released atleast for the days worked from date of submission of Resignation letter, i.e from March 1st to April 11th. Generally full salaries for vacation is also paid to those who continue in employment.  What does our Indian Labour Law and precedents state on this subject. Kindly clarify our query at the earliest.

You may also post the school is in which state and you may download the rules framed by State Education Act and by Directorate of Education of your state!
