Notice period

Hi


I am working with an organisation where I have to serve the notice period of 3 months, in case of resigning from services.

I resigned from the services with a notice period of 20 days but company wish me to serve for 2 months.


I am ready to buy back the notice period for remaining days with company. 

Would it be possible to serve the 20 days notice period & getting relieved from services. If I put a mail to senior officials for this & my agreement to pay to company for notice period, would there be any legal implications?


What does labour law says?

i can tell u about delhi......delhi shops and establishment act talks about 1 month notice period...companies generally have 3 months notice period in their employment agreement which legally is not correct....but that can vary state to state as i have not done state wise research...however 20 days notice cannot be served neither legally nor as per ur companies policy...but companies management or HR team might consider ur case and accept ur resignation letter if ur case is genuine and exceptional. its a complete management decision.
