Occupation certificate

I have purchased a flat at Nashik sometime on 10.10.2014, The builder has confirmed to me in writing that Occupation certificate has been delayed and he is responsible for all the consequences till the Certifiate is issued.

Now, he has sold all the flat and all the members are residing in the flats and he has started collecting Maintenace. Now, my point is this:-

1. Since all the flats are sold out perhaps more than a year back, is it possible to refuse maintenance charges. I think as all the flats are occupied we can form a society or association and handle society's affairs. Why should we give Builder maintenance charges?

2. It is more than two years that he has undertaken to make available occupation certificate, now can we put all the expenses incurred in the building untill occupation certificate is made available.

3. Is it possible to form a society or association without occupation certificate?

File a complaint under RERA since OC is not received he is liable to procure it.
