Order passed by municipal commisiioner

my dear
friends

my client owns a hotel he is aggrieved by the order passed by the municipal commissioner wherein he has stayed the conduct of any marriage party.... alleging it illegal

the order is passed under rule 53 (3) of madhya pradesh bhumi vikas niyam 2012 which is applicable to marrige gardens and not hotel industry...

 

kindly apprise me with necessary legal position

1. The order passed by the concerned authority appears to be lawful. It appears that no prior N.O.C. has had been obtained form such authority for use of open land for such commercial purpose like a for marraige reception. If such land is demarcated as covered under Develpment Scheme like Town Planning and F.P. number has been given then also and not necessiating to get a N.A. sanction still such prior N.O.C. from the conerned local auhorities is mandatory. There should also be some provisons in such rules for filing appeal against such orders. I hope this reply meets with your inquiry.
