Owning a website

Dear Sir,

 

My friend is working for a IT MNC. While appointment, he has agreed to the stipulation that he will not hold any business in private other than the job

   Recently to supplement is income, he has started a website which displays ads (Pay Per Click) and started earning a decent income.

1. Please let me know whether the company can initiate legal action against .

2. Holding a website will be considered as private business .Please Clarify?

If it is unrelated to his sphere of job or to the company's line of business, he can do it and provided it does not hinders his regular duties & responsibilities in the Employer's company.

Though the nature of job is almost one and the same, we need to check up the terms and conditions of his appointment orders.  Since he is employed in a private MNC, there is no bar to undertake any remunerative tasks as long as it is not hindrant to his role as an employers as already our learned friend opined.
