Partition law

1.The case is about a dispute between a husband and a wife for a property which was purchased jointly.

2. The wife never resided in that property, the property was rented and after the dispute between the husband and the wife, husband moved out to live in that porperty.
3. Now, the wife wants a partition of the joint property.
 
How the law of partition works over here that is in the case of a husband and a wife?

Since the wife is co-owner in that property, she can file a suit for partition  and declaration on the the said property and seek her rightful share as a co-owner of the said property. She is entitled to 50% share in the said property.
