Partition memorandum

I and my brother partitioned the property  and now written the memorandum of partition and wants to mutate some property by way of memorandum of partition but the  TILR officer asking for registration of the same document and to pay the stamp duty on it  I want to know the status of document of Memorandum of Partition is it necessary to pay stamp duty and registration

Yes. If you have to go for registration of the Memorandum of the Family Partition Deed, then you have to pay the applicable stamp duty for the same by way of adjudication.

The partition deed should be registered properly with the concerned registrars office otherwise it is not legally valid. The revenue department will not recognise the unregistered partition deed for mutating the records on individuals name.
