Partition of property between brothers

Hello Sir

my grandfather had 3 sons..he died in 2004 and my grandmother also died within a month.

my father, the youngest son and the eldest uncle want to divide the whole property but the middle uncle is creating problem. As my eldest uncle is single and lives along with us.

so how should my father get the property partitioned if the middle one is not willing to do so??

is there a legal method for partitioning of  the ancestoral property??

how much time and money will be spent on dis??

Very interesting query and even I would like to learn.

Send a legal notice to the brother demanding partition. If he still is not ready for partition, then file a suit for partition in the court. Consult a local lawyer.

Partition suit is the best option, making all the legal heirs as parties to the suit.It may take one to two years for decision of the case.Lawyers fee may vary from one lawyer to another.
