Pay n park

our co operative society has passed a resolution for Pay N Park in the open space of our building.

in that they have passed a resolution that those who are leaving on rental basis can not park their cars in the same open space.

Morover they are also passed a resolution that all the leave N license agreements needs to be registered.

Can society pass such resolution, as registration of agreements is an costlier affair, moreover can they force for the same

Sir,

The AGM of a CHS can pass resolutions of parking charges and can deny parking facilities to                 non-members.

The member has to register the Leave & License agreement as also get a verification from local police station for the licensee, and the society can ask for the registered agreement as well as police verification.

but as per registration act 1908, registration for 11 moth agreement is optional then how societies can ask for the same.

Moreover police have given NOC on non registerd agreement, still society is insisting for registration

Sir,

If you are in Maharashtra, then you are governed by Maharashtra Rent Control Act 1999, under this Act registration of a Leave & License document for 11 months is mandatory.

If, however, you are a resident of some other state, you are governed by the regulations of that State.

Sir,

Further, the Police department is  not concerned with the registration of a Leave & License document, it is concerned only with the identification, verification & antecedents of the licensee.

dear Kishore ji,

but maharahstra rent control act says that registration should happen as per registration act 1908, which clearly states that 11 month agreement is optional for registration.

where as there are no of lawyers who make this type of agreements and there are no of people who do noterised such agreement.

If the same is not legal then they might not do that. yesterday i was in court and i saw a layer executive LL agrrement in mumbai.
