I am Santosh Kumar, employee of Coal India ltd as a assistant manager (Mining) from 20 February 2013. Previously, I was working as an assistant Manager (Mining) in FERRO ALLOYS CORPORATION LTD (Facor), Bhadrakh, Orissa. Company was giving to me salary with RS 28500 quarterly incentive amount. company has written about incentive money that “ incentive amount shall be paid to you subject to the term and conditions of the incentive Scheme of the Company”. I have not got written documentary information regarding pay back of incentive amount or return advance bonus at the time of interview or joining. i had not done any agreement on Bond Paper regarding it. After 1.5 year, company has shown to me rule regarding incentive amount pay back.
According to rule, if I will leave the job then I will refund all entire INCENTIVE AMOUNT (rule has not mentioned that period of return incentive amount). After closing (In February 2012) of one mine (Boula Chromite mines) due to forest clearance problem, company has shifted (march 2012) to me in another mine (Kathpal Chromite Mine). Again, second mines closed due to lease period over. After the closing of second mines, In November 2012, company has informed on notice board for deduction of 30% of employees salaries as a support and solidarity to the management in view of temporary closure/stoppage of mines. Again after some days, incentive amount kept abeyance and I have not got last quarter incentive amount and got payment only 70% salaries. I have not got Underground Allowance from March 2012 to September 2012 at Kathpal mines also.
Due to underground Allowance closed, 30% salaries deduction and incentive scheme closed, I had got very less salary from the month of October and my life was puzzled. My family was also tensioned for future. I have done wait for four months to get a good working environment but failed and result culminated as resignation on 07 February 2013 for the better sustained future, growth & career with Coal India Limited. I have not availed three month notice period. Now company is demanding three month notice pay (100% of salary) (RS. 83518.00), all entire incentive amounts (RS. 1,71,000.00) and some amount of advance (RS. 9,906) which is given as bonus in session 2010-11 and I have already paid tax on advance Bonus amount and incentive amount. while I was interested for return to company only three month notice period.
please guide me what i should do
