Payment delay beyond agreed period-sale of residential land

Hello legal fratenity,

Looking for advice.

As a family we have sold a piece of land to a builder for a certain sale consideration (chennai) with an agreement of payments to be made within 12 months. However, the said builder/buyer has paid only 50%, even after 14 months period.

Also............we have provided "power to construct" to the buyer.

The builder/buyer has invested 50 lacs worth consruction so far.

We have NOT entered a JV.....it is just a sale. with a clear cause mentioning "time is the essence of this contract". The buyer asks extra time & lapses later. His attitude is the same everytime. There were cheques bounces & fake promises of payments. What can we do in the given circusmtances?

File the criminal complaint for cheating, Cheque bounce cases as well as Civil case for the breach of the contract.
