Payment of vat for purchasing a ready possesion flat in 2009

Dear Sir,

I had purchased a ready possesion 1bhk flat in the year 2009. At that time VAT was no in the rules to be pid to the builder. Now he has seved me notice and later court summon for paying the VAT. Please give your appropriate guidlines for the above problem and do the needful.
