Personal presence on date of filing case u/s 138 ni act

I am to file a cheque bounce case in Kolkata where I maintain my bank account in which the dishonoured cheque was deposited. However, at present I am not in the city and want to know If I personally need to be present in court at the time of filing the complaint and or before summons are issued to the accused?

No you don't require to be present yourself personally. Unless the court calls you it is lawyer who has to be present in front of the court not you.

Thank you for your response.

However, I have been told that incase I am not being able to personally present alongside my lawyer during filing of suit, someone with a POA from me needs to be present and initiate proceedings on my behalf.

your advocate can file the case. you need to be present for verification on any other date
