My father has filed maintenance petition u/s 125 Cr. pc from his two male children. He is an ex-govt employee getting pension about 13000 PM. His claim is he is getting meager pension and needs 10000 Rs. each from his two children. He is staying with his brother even though we asked him to stay with us. According to him we are getting very high salary and paying maintenance of 10000 Rs each will not be hardship to us. He applied for Interim application, after we submiting his pension certificate of 13000 Rs per month and some Fixed deposit on his name court dismissed the interim appln. In deed court has asked him to produce evidence. He is not taking care of his wife and she has filed domestic violence case against him. Pls suggest that is my father really applicable to get maintenance as per the law....
