Can a planning authority maharashtra regional town planning Act under sec 22 A without permission of a owner / holder of property can handover passession for rehabilitation when ULC case is not decided file was lost by the collector when files are trasferred to commissioner for change in jurisdiction the conserened persons were now & then enquiring for the same and after four years it was locked when gone through it it was dismissed before two years that is when i was constantly trying for its whereabout and when mother expired in whos name was the property it was default and dismissed (on 13-1-2000) by displaying the notice to our layers address who was expired long before i.e. in 1992 . which was restored in 2006 after long long fight and then released in 2009 as the ULC act was repealed . Is it legal a development authority took said land where collector Govt. dept etc all involved and rehabilitated Slum.
A want to know wether a land under ULC can be included in development plan under sec 22 A when case is not decided .
