please guide me...
here s my case
1. X bought land plot in 1993
2a . X gave power of Attorney to Y who is wife of that land broker
3. Y kept the land documentsin pawn shop (ownerZ) for money and because they didn t return money Y registered the plot in Z 's son name. in 1996
4. plot sold to mr.G , from whom i bought in 2004. got all the original documents
problem started in 2009
X executed settlement deed for the same plot to his/her son and got patta too in 2009.
they built a wall around the plot in 2010, which i came to know . after filed a pollice compliant in 2010 and filed a case in court to cancel there settlement deed.
police investigation till now found out that X 's given power of attorny is not with original signature. now awaiting finger print confimation.
X version is that land broker kept the document and sold it fraudulently. seems to be true because 4 others cases similar to this are done by that land broker.
my question now is who will be the owner ...
X did not have the original documents for the past 16 years and never claimed their property.
we got loan from govt and bought with all original documents from mr.G. in 2004.
please advice me the next course of action.
1. continue the case - i would win
2. go for mutual settlement (they are offering 25% of current value)
3. continue the case and loose after a long wait.
please let me know if i have any law thats helpful for me.
