Is the transfer of immovable property in blood relation (through gift deed) exempted from stamp duty in New Delhi
if not then the what is the rate of stamp duty charges
Nu.Delhi.Law.Fora. (Advocate-on-Record Supreme Court of India) 06 December 2012
Dear Querist,
For effecting transfer through quantum of Stamp Duty payable in New Delhi, it may be noted that the stamp duty charge varies for male and female property Transferee. The charge is 6 per cent for males, 5 per cent in case of joint purchase (male & female) and 4 per cent for females.
In Delhi, the circle rates of different zones from A to H category determine the market value of a property.
As regards transfer through Gift Deed, you may note that 3% of the market value of the property will be the stamp duty. Since there is no any consideration passed on, a Gift deed is made out of affection and it is expected to be within the blood or lose relatives.
Trust this would be fine.
