Please help

Dear Experts

I seek your valuable advice.

My story:-

I got married for second time with lots of hopes.I have a son from my ex husband.Before marriage my present husband agreed to take financial &emotional responsibility of my son along with me.After marriage he didnot keep his words.Started giving troubles,neglect & treat badly my son.Even he forced me to seperate myself from my son,ultimately I could not bear & left his home this 5th April 2013.

My queries are as follows:-

1.After how long I can seek for divorce?

2.I want mutual consent divorce..If he is unwilling what should I do?

I want hassle free divorce...donot want maintenance.

Dear Querist

1.After how long I can seek for divorce?

you can file a divorce petition after one year of completion of your marriage, but if the case is comes under exceptional then can be before one year.

2.I want mutual consent divorce..If he is unwilling what should I do?

Mutual Consent divorce is possible only when both the parties of marriage is ready to MCD, fight the case with honesty.
