Dear friends

I would like to know that in a case U/s 323 /341 IPC, the I.O has stated that he has not personally seen the commission of the offence and what he knows was derived from the eye-witnessses. But in my case none of the  eye-witnesses cited by the prosecution were examined by the Court. Either they fail to identify the accused or turned hostile. How should i go about? Could the accused be convicted relying only on the statement of the complainant and the Investigating Officer?
