Poa in 13b

I am in Canada but i fly back in feb 2016 to file divorce application in district court under 13B.

First motion is already done and 2nd motion will be on 25 July 2016.

I want to know can i give power of attrony to my father for 2nd motion/final step ? because i may not get leave for it . My laywer said no but some of my friend got divorced via POA in 13B.

Please advise me .

Yes you can send POA for your father for the second motion, if your lawyer doesn’t agree better change him as he is a novice. I got divorce by mutual consent without the person's appearance in so many cases by using the POA given to other relatives and even to me in few cases on their behalf. It all depends on the experience, knowledge and confidence of your lawyer to get things done.
