Precautions and advice before asking for divorce

 

I have got married (under the Hindu marriage act) and my wife gave me some false information which was the basis of my decision to accept her as my wife. She has not just hidden this information about her past but told a white lie which is unacceptable. Unfortunately, there is no way for me to prove anything legally. I feel betrayed and I am not able to accept her even after making some efforts and I think it will be good for both of us to go our separate ways. I have a travelling job and we are not living together from last few months. She is currently living with my parents in our house.

 

a. How should I safely go for a divorce considering a fact that her family may go to any extent to give us some trouble like charges of dowry demand or anything even worse? I don't want to put my parents into any trouble. Is there any legal way to write to police in advance about our intentions or something we can do to avoid any hassles. Please suggest any precautionary measures I should take before declaring our separation.

 b. My wife is well qualified (MBA) and currently working as a Manager in a MNC fetching a decent salary. What amount (or range) can I expect to be claimed by my wife on separation as some standard prevailing for divorce settlement in middle class families living in Delhi?

If you file a divorce case on the basis of Cruelty you can get a divorce.

It will be a long drawn legal battle , you may escape paying any thing if cases are faught properly.

But collect evidence , legal system works on evidence.

YOu can go for nullity. If after dicovery of the said fact you are not cohabiting with her.
