Pregnant woman forced to resign

My wife was working for Accenture India (Hyderabad). She went on loss of pay for 4 months. When she returned and informed that she is pregnant her employer (Accenture) made her to resign quoting performance as reason. They gave difficult assignments to complete during that time. Even though she completed those assignments, they told that they have to let her go since she has to go on maternity. They asked her to mention 'personal' as the reason for resignation and made her to leave the job.

Can I take any action on that company. There is no written proof that the they fired her or forced her to resign.

Even though she submitted resignation letter ,you send a notice to that company stating that it is obtained by force.no pregnant woman can be terminated according to law.

Forcede resignation is offence and can also be termed deemed termination, even if the employee is not female and is not pregnant.

 

Termination (including but not limited to by forced resignation) is illegal during Maternity Benefit Period.

 

She caqn lodge complaint with police, Inpspector appointed under Maternity Benefit Act (Central, in this case, however you can check on your own),  Inpspector appointed under State Shops & Estbs Act, O/o labor commissioner, Employee's/Trade Unions etc preferably under the expert advise of your counsel specializing in labor-service matters.
