Procedure to file a crpc 156 - tamilnadu

sir, what is the procedure to file a crpc 156 in tamilnadu if the complainant is residing abroad.. can it be filed online? this is in regards to a gold loan theft happened 3 months back and the police inaction on it for not filng the FIR on it till now.

is crpc 200 also required to be filed along with crpc 156?

mr/ms profile9999 why are you reading too much of CrPC ???

 

let that job be for advocates and judges. its good that you want to acquire knowledge but still if you are not law graduate then these sections and rules will only confuse you.

 

the simplest solution to you is to approach magistrate with your local lawyer for disposal of your problem as you said that police is not helping.

kindly read section 2 and 3 of IPC which tells about the intra jurisdiction and intra extra territorial jurisdiction of IPC. i hope you will be enlightened if at all you could get it completely.

 

and FYI even if the accused resides abroad the Indian law can punish him/her very well.

the summons etc will be served to him via embassy.

Contact, consult and engage a local lawyer for proceeding in a professional manner.

Better contact a lawyer within your home town jurisdiction, apprise him the facts and give instructions to file a petition under the said provision of law but you need tto sign the affidavit and get it notarised from that country itself and send it to your advocate from there if you are not able to come down.
