Promisory note & sec138

my brother had taken loan of rs.4.5lac from a friend, and signed a promisory note on 100rs stamp paper with witness- he had paid some of the money on monthly basis aprox 60K thru cheque to him -but due to loss in business was not ble to pay the rest of the money. now his friend started threating him and bounced his cheques given for security purpose for rs.4.5lac full amount & given notice under sec 138 for which he had given the reply than also his friend had filed a cheque bouncing case under sec 138 for which court summon is also received- what course should he take to fight this case - is there any merit to fight the case legally and what consequences he can face even if there is no merit in fighting the case?

Kindly arrange and adduce evidence to defend in court. If it is proven that the cheque was for security you have good chance to save yourself. Reg Advocate Pradeep kumar 9871765000
