Property

Hi,

 

My father had two marriges, and his first wife dies and had a son and a daugher, then he got married to my mom and I am the only daughter of her.

 

My sister has died as well, but she was married and has a son.

My father was a govt employee and so was my mom, so after my fathers death, she did not take the job(as per govt) and gave it to my step brother.

 

Now my parents have a joint property, and my father died back in 1993, and also since the begining my mother has paid off all the bills and EMIs (which has now finished).

My brother is married, and his wife is not very good.

 

I am married too and I live out of city.

 

My mother is quite worried, that they might start living forcefully there.

 

So is she sells the house, can we pay his part  (and my sister's son) in cash and will that be over?

 

What are the consequences if she does not sells it, and they start harrasing her?

 

Please advise...

Yourself, your mother, your sister's son, your brother all are have rights in the property of your father and your sister in law does not have any right to sell the property of her own.  Even your brother cannot sell the property without your or your's mother knowledge.  Alternatively, you can file a suit for partition of the property in the Court of Law.
